What is responsible lending?
Responsible lending is the practise of making information about the loan service and the agreement that the customer will enter into, easily accessible and understandable.
This includes making details about costs and charges transparent during the sales process, at the point of sale and in all communications following sale and agreement.
Banks and financial service providers have been obligated to enter into the Consumer Credit Act and the Banking Code for a number of years.
However, the banking code is fluid and ever changing, with many lenders campaign for changes to the code that suit their own practise.
This has led to a situation where different banks, lenders and financial service providers can produce their own lending code of conduct.
What is the Banking Code of Practise?
Following the financial crisis of 2008/2009 governments around the world and here in the UK have sought to impose regulated practise upon the financial services industry, with varying degrees of success.
The revised code commits banks to tighten their credit checking procedures prior to loan approval and to be able to provide more assistance to customers who find themselves in financial trouble
Where most lenders agree with what the current Consumer Credit Act and the Banking Code infers is that all lenders examine carefully the ability of customers to repay loans and pay for services before they enter into any agreement.
The agreement also states that the preferred manner of noting the cost of financial products, such as payday loans, is APR. This method favours the providers of long term loans, loans that do not need to be repaid in full for 1 year or more, but gives a detrimental impression of the Payday Loan industry.
